General Terms and Conditions – Technical and Planning Check of a Plot
INFORMATIONAL TRANSLATION. This English text is provided for information only. The contract is concluded in Czech, and the Czech version (VOP-cs) is binding. If the two versions differ, the Czech version prevails. This does not affect the rule that an ambiguous term is interpreted in the way most favourable to the consumer (§1812(1) of the Czech Civil Code).
Version 1.0, effective from the day orders open (until then this is a draft).
Statutes cited in these terms are cited as in force on the date these terms were issued: Act No. 89/2012 Coll., the Civil Code ("CC"), as in force from 1 Jan 2026, and §1830a CC (the withdrawal button), inserted into the Civil Code by Act No. 159/2026 Coll. with effect from 1 Jan 2027; Act No. 634/1992 Coll., on Consumer Protection ("CPA"); Act No. 283/2021 Coll., the Building Act; Government Regulation No. 29/2023 Coll., as amended by Government Regulation No. 66/2026 Coll.
1. Provider and contacts
1.1 The service is provided by me, David Musijenko, a natural person doing business under the Trade Licensing Act, ID No. (IČO) 08884501, registered office (place of business) Studentská 1024, 250 91 Zeleneč, registered in the Trade Licensing Register (živnostenský rejstřík) kept by Městský úřad Brandýs nad Labem-Stará Boleslav, živnostenský úřad (the "provider", "I" or "me"). I offer the service and issue the reports under the name Everlot.
1.2 Contacts: the contact e-mail will be published before orders open. You can send order questions, complaints about defects, other complaints and withdrawals to the e-mail address. You can keep our written communication in text form (e-mail).
1.3 I provide the service under a trade licence for the unrestricted trade "Advisory and consulting activities, preparation of professional studies and assessments" (Czech: *Poradenská a konzultační činnost, zpracování odborných studií a posudků*).
1.4 I am not a VAT payer (nejsem plátce DPH). All prices are final and no VAT is added.
2. Definitions
2.1 The customer is the person who orders the service from me. A consumer is a customer acting outside their business or independent profession (§419 CC).
2.2 The service is the preparation and delivery of the report under section 3. The report is the result of the service in HTML and PDF format.
2.3 A plot is one or more parcels named in the order that are sold in one sale and lie in one cadastral area.
2.4 A confirmed order arises when both of the following are met: (a) the price has been credited to my account or confirmed by the payment gateway, and (b) the parcel has been identified under section 7.
2.5 Working hours are hours on Monday to Friday, except public holidays and other holidays under Act No. 245/2000 Coll.; they are counted in the same way as the delivery time under section 8.2.
3. Subject, scope and nature of the service
3.1 I prepare for you a technical and planning check of the plot from publicly available sources and deliver it to you as a report. The report gives an overview of risks and of the documents to obtain before you commit to a plot (for example by buying it).
3.2 The report contains (to the extent the data for the plot are publicly available):
- identification of the parcels, area, land type and a comparison with the listing;
- the data of the official land-register extract (výpis z listu vlastnictví, "LV") for the plot, which I obtain for the paid order through ČÚZK remote access (dálkový přístup) and read (section 7.3): the type and number of owners without names, liens (zástavní práva), easements, pre-emption rights, "plomby" pending-entry flags and notes of pending proceedings (the entries in parts B1, C and D) and the data in part E (titles of acquisition), as facts without any legal assessment; the report gives no names of natural persons; for the parcels of the access route to a public road, the type of their owner (municipality, state, natural or legal person), without names;
- from the public land register LPIS: whether the plot lies in a registered land block and who is recorded as its farm user (a legal person by name and ID number (IČO) if public, a natural person only as "fyzická osoba" (natural person), without the name); whether the plot is let or under a farm tenancy does not follow from the register, and the report states it as a question for the seller;
- the zoning plan (územní plán): the version in force, land-use zones, regulations (quoted), an indicative calculation of the buildable area, requirements for a zoning study or regulatory plan, public-benefit structures and measures, pre-emption rights under the zoning plan;
- land-use limits and protection zones, access from a public road according to the cadastral map, existing and planned utility networks according to public data;
- agricultural land fund (BPEJ soil units and protection class; I do not compute the farmland levy: the farmland protection authority sets it, and the report states its basis), floods, water protection and drainage, slope, radon, undermining, landslides, nature and forest protection, archaeology and heritage, noise, planned projects within 500 m;
- the asking price from the advert and a comparison with 10 to 20 listed building plots in the same municipality (if there are fewer, I add the nearest municipalities); each listing is given with its link and capture time, and the report states the band and the count; this is a comparison with listings, not a valuation;
- indicative ranges for the costs before building, only where the range has a source stated in the report; for other items I state who sets the price (a contractor's quote, the network operator or an office) and what the overview leaves out; this is not a quote or a budget;
- drafts of letters and e-mails in Czech that you send yourself, in your own name: an application to the building office for preliminary information under §174 of Act No. 283/2021 Coll., questions to the concerned authorities, questions to network operators and questions to the seller; they contain only facts from the report and the questions; applications and questions to offices state the provisions they rely on;
- for each finding: the source with a link, the query date and the finding's status (Rules out building / Open / Limit / Cost / Fine / Not checkable from data); what public data cannot settle is stated as an open question (status Open or Not checkable from data) with who decides it;
- a list of documents I recommend you request, and from whom, including the preliminary information (předběžná informace) from the building office under §174 of Act No. 283/2021 Coll.
3.3 The report does not contain and the service does not include:
- a site visit, measurement, setting out or surveying;
- a legal service under Act No. 85/1996 Coll., on the Legal Profession: legal advice, legal analysis (including an analysis of your own position, e.g. the consequences of a lease or farm tenancy), assessment of the validity or enforceability of rights, contracts and deeds, drafting or commenting on contracts or contract terms (including reservation and deposit terms); such questions are listed as questions for an advokát;
- an expert-witness opinion (znalecký posudek) under Act No. 254/2019 Coll., a valuation or an estimate of market value (the comparison with listings under section 3.2 is not a valuation);
- design documentation, a zoning study or any other reserved activity under §155 of Act No. 283/2021 Coll.;
- dealing with authorities, network operators or the seller on your behalf (you send the draft letters under section 3.2 yourself);
- data that are not publicly available on the query date (e.g. unpublished zoning-plan changes, network capacity and connection price, unregistered rights, private agreements, the actual state on site).
3.4 The report is not an official document. It does not replace the preliminary information of the building office or of a concerned authority under §174 of Act No. 283/2021 Coll., an extract from the land register, statements of network operators, or any decision or opinion of an authority. Only the competent authority decides whether a project is permitted.
3.5 The report states what the listed public sources contain on the query date. It does not confirm that the data in public registers and documents match reality, and it does not reflect changes after the query date stated for each finding. This does not affect your rights for defective performance or to compensation if the report states the content of a source incorrectly or incompletely (sections 13 and 14).
3.6 The report does not recommend whether to buy the plot. Questions that need a legal assessment are listed in the report as "questions for an advokát (Czech lawyer)".
3.7 Quality control. Before delivery, software checks the report: it compares every quote with the archived source text, recomputes every calculation and does not issue a report that fails. The check does not verify whether the public sources are correct (section 3.5), nor my reading of the map and the rules (zoning plan, statute).
4. Prices
4.1 Prices per plot (one parcel):
| Tier | Delivery time | Price |
|---|---|---|
| Launch price (first 10 plots, Standard tier) | within 48 hours | CZK 1,490 |
| Standard | within 48 hours | CZK 2,490 |
| Express | within 24 hours | CZK 3,490 |
4.2 Add-ons: +CZK 490 for each additional parcel of the same plot (section 2.3) and +CZK 490 for each additional report language (Czech, English, Russian). You choose add-ons yourself in the order; none is preselected.
4.3 The launch price applies to the first 10 plots ordered from me in total (by all customers together) in the Standard tier; the number remaining is shown on the website. Before you send the order I always show whether it applies to your order; the price shown in the order summary is decisive.
4.4 The price does not include fees of authorities or third parties for documents you may request yourself based on the report (for example a certified extract for a bank). The land-register extract under section 3.2 is included in the price. There are no delivery costs. I charge nothing extra for means of distance communication.
4.5 I am not a VAT payer. Prices are final.
5. Payment
5.1 You pay the full price in advance by card through the payment gateway or by bank transfer. I do not ask for any other deposit.
5.2 I send the payment link with the order number only together with the confirmed parcel (section 7.2). Please pay within 3 working days of that e-mail, whether by card or by bank transfer. If by then the price has not been credited to my account or confirmed by the payment gateway, the contract is cancelled and you owe me nothing.
5.3 I will send you a payment receipt by e-mail.
6. Order and conclusion of the contract
6.1 You place the order on my website. Steps: (1) enter the plot in one of three ways: a listing link, the cadastral area and parcel number, or a link to a point on a map or the coordinates of a point on the plot; (2) describe the intended use, choose the tier, report language and any add-ons, and you may state by when you must decide; (3) enter your e-mail and name; (4) check the order summary (subject, price, delivery time); you can go back and correct the data; (5) decide whether you ask for an immediate start (section 11.3); (6) send the order with the button "Objednávka zavazující k platbě" (Order with obligation to pay); (7) I confirm by e-mail the parcel, which I identify free of charge in the public ČÚZK viewer Nahlížení do katastru nemovitostí, and only with it send the payment link with the order number (section 7.2); (8) you pay; only for the paid order do I obtain the official land-register extract (section 7.3).
6.2 You can correct input errors at any time before sending the order, with the "Back" button or directly in the form fields. After sending, e-mail me the error; I will correct it free of charge as long as I have not started work on the report.
6.3 The contract is concluded when I send you the order confirmation by e-mail. I send it without undue delay, normally automatically right after you send the order. The confirmation includes these terms, the withdrawal instructions and the model form in text form (PDF), and a statement of whether you asked for an immediate start.
6.4 I conclude the contract in Czech. The English and Russian translations of the terms are for information. I send all communications under the contract in Czech; on request I attach an English or Russian translation. The report itself is delivered in the language you choose (Czech, English or Russian).
6.5 I archive the concluded contract (the order and these terms) electronically for the period stated in the Privacy Policy. I will send it to you again on request.
6.6 By its content, the contract is a contract for work with an intangible result (§2586, §2587, §2631 and §2632 CC). For the consumer's right of withdrawal it is a service contract. The electronic form (HTML, PDF) only serves to hand over the result of the service; it is not a supply of digital content (Art. 3(5)(a) of Directive (EU) 2019/770).
7. Inputs, identification of the parcel and the land-register extract
7.1 I need from you a listing link, or the cadastral area and parcel number, or a link to a point on a map or the coordinates of a point on the plot. I recommend also stating the intended use (e.g. "family house, footprint approx. 90 m², 2 storeys, no basement").
7.2 Within 4 working hours (section 2.5) after you send the order, I e-mail you the parcel I identified from your input, with a link to the cadastral map, and only together with it the payment link with the order number. If the parcel is not the right one, do not pay and write to me. If your input does not identify the parcel unambiguously, I first ask you to clarify and send the payment link only after that. The delivery time starts only with the confirmed order (section 2.4).
7.3 The land-register extract. For the paid order I obtain myself the official land-register extract (výpis z listu vlastnictví) for the plot through ČÚZK remote access (dálkový přístup); the LV extract is included in the price of the report. For the access-route parcels I establish the owner type from an LV extract or from the "Informace o parcele" (parcel information) output, which I obtain the same way through ČÚZK remote access. The report states the date of the extract and its data to the extent of section 3.2. I do not hand over the extract itself because it contains personal data. I use the Nahlížení do katastru nemovitostí viewer only to identify the parcel free of charge before payment (section 7.2). I do not need an extract from you. If you send me one anyway, it serves only as a cross-check: the report's source remains the extract I obtain myself, and if your extract differs from mine in the data under section 3.2, I obtain a new extract before delivery and state its date in the report.
7.4 A different parcel. If, before the report is delivered, you write to me that it is a different parcel, the order stays: I identify the parcel again from your input (first asking you to clarify if needed) and send you a new e-mail with that parcel and a link to the cadastral map and, if you have not paid yet, again with the payment link with the order number. The payment period under section 5.2 runs from that new e-mail, and the delivery time from the confirmed order (section 2.4) with that parcel, so no earlier than that new e-mail. If the parcel cannot be identified within 24 working hours (section 2.5) after you send the order (for a different parcel, within 24 working hours of your message that it is a different parcel), or you cannot confirm the parcel in the new e-mail either, the contract is cancelled and you owe me nothing; if you have already paid, I refund the full price. This period can be extended only with your consent.
7.5 I do not accept orders for plots outside the Czech Republic. If the plot lies outside the Czech Republic and this comes to light only after the contract is concluded, the contract is cancelled and I refund the full price. I do not handle requests to assess contracts or the validity of rights (section 3.3); I deliver all other parts of the service in full.
8. Delivery times and compensation for delay
8.1 I deliver the report within 48 hours in the Standard tier (also at the launch price) and within 24 hours in the Express tier, counted from the confirmed order. If you did not ask for an immediate start (section 11.3), the delivery time starts only on the first working day after the withdrawal period expires (but not before the confirmed order).
8.2 The time is counted in hours and does not run on Saturdays, Sundays, public holidays and other holidays under Act No. 245/2000 Coll. Example: an order confirmed on Friday at 15:00 is due in the Standard tier on Tuesday at 15:00; if Monday is a holiday, on Wednesday at 15:00. I state the exact due time in the e-mail confirming that your payment was received.
8.3 The same delivery time applies to extra languages or extra parcels.
8.4 If I do not deliver the report on time, I refund 30 % of the price paid without you having to ask, within 14 days of the due time.
8.5 If the report is delivered more than 24 hours after the due time (counted under section 8.2), or is not delivered at all, I refund on your request the full price paid (including the 30 % under section 8.4, i.e. 100 % in total), and you keep the report. An e-mail request is enough.
8.6 The compensation under sections 8.4 and 8.5 does not exclude or limit your statutory rights in case of delay, in particular the right to withdraw from the contract (§1977 and §1978 CC) and the right to compensation for damage.
8.7 Time limits for documents from third parties (preliminary information under §174 of Act No. 283/2021 Coll., network operators' statements, etc.) are not part of the service; the report says what to request and from whom.
9. Municipality without a published zoning plan
9.1 If, after identifying the parcel, I find that the municipality has no publicly available zoning plan (on the municipality's website, the National Geoportal of Spatial Planning, the regional portal or at the municipality with extended powers), I tell you without undue delay. The delivery time does not run until you tell me your choice under section 9.2.
9.2 You choose one option: (a) cancellation of the order and a full refund, or (b) a report at 50 % of the price, in which the zoning plan is stated as an open question (status Open); I refund the 50 % difference.
9.3 In case (b) the delivery time runs from the receipt of your choice. If you do not choose within 3 working days, option (a) applies and I refund the full price.
9.4 If you have not paid yet: do not pay until you choose; the payment deadline under section 5.2 does not run until then. Option (a) means the order is cancelled and you owe me nothing. For option (b) I send you a payment link for 50 % of the price; the payment deadline under section 5.2 runs from that link and the delivery time from the confirmed order (section 2.4). If option (a) applies under section 9.3, the contract is cancelled and you owe me nothing.
10. Delivery of the report and follow-up questions
10.1 I deliver the report by e-mail as a PDF and HTML file (attachment or a download link valid for at least 30 days). The report is delivered when this e-mail is sent.
10.2 Follow-up questions: for 7 days after delivery you can e-mail me questions about the content of the report (explanations of findings, sources and recommended steps). I normally reply within 2 working days. I answer free of charge, beyond the paid service; answers do not include a new check, another plot, or legal advice.
10.3 The paid service is the preparation and delivery of the report; the service is therefore fully performed when the report is delivered. The free answers under section 10.2 are not part of it. Your rights for defective performance (section 13) are not affected.
10.4 Written questionnaire. On the seventh day after delivery I send you a short written questionnaire (at most 5 questions). Answering is voluntary. If you do not want the questionnaire, tell me by e-mail and I will not send it (objection under Art. 21 GDPR). I do not contact you by phone.
10.5 Accuracy check after 30 days. If you give a separate consent in the order (the box is not pre-ticked and the consent is not a condition of the order), I send you on the 30th day after delivery one e-mail asking whether the office, the network operator or the seller confirmed what the report said. You can withdraw the consent at any time by e-mail.
11. Withdrawal from the contract (consumers)
11.1 Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day the contract was concluded (§ 1829(1) CC). The days are counted from the day that follows the conclusion of the contract (§ 605(1) CC): if the contract is concluded on Monday 5 Oct 2026, the period ends on Monday 19 Oct 2026. If the last day falls on a Saturday, Sunday or public holiday, the last day is the next working day (§ 607 CC). You can withdraw from this contract by any unequivocal statement addressed to David Musijenko, Studentská 1024, 250 91 Zeleneč, the contact e-mail will be published before orders open (for example a letter sent by post or an e-mail). You may use the attached model withdrawal form (Annex 1), but it is not obligatory. My website has a withdrawal form on the withdrawal page (the "Odstoupit od smlouvy" (Withdraw from contract) link is in the footer of every page and in the order-confirmation e-mail). You fill in the form and the "Potvrdit odstoupení od smlouvy" (Confirm withdrawal) button opens an e-mail with the text filled in, in your own e-mail program, which you send yourself; or you print the form and post it. The page itself sends nothing: you withdraw by sending that e-mail or letter. I will confirm receipt of your withdrawal in text form (by e-mail) without undue delay, including its content and the date and time you sent it. To meet the withdrawal deadline, it is sufficient to send your withdrawal before the withdrawal period has expired.
11.2 Effects of withdrawal. If you withdraw from this contract, I will reimburse all payments received from you under the contract without undue delay and no later than 14 days from the day I receive your withdrawal. I will use the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result. If you requested that the services begin during the withdrawal period, you will pay me an amount proportionate to what has been provided until you informed me of your withdrawal, compared with the full coverage of the contract (§1834 CC). I will set this amount off against the refund and, on request, show you what part of the work was done.
11.3 Start of performance within the withdrawal period. I start work on the report during the 14-day period only at your express request, made by ticking a box in the order (§1824a(3) CC). The box is not pre-ticked and ticking it is not a condition of the order. If you do not ask for an immediate start, I start work only after the withdrawal period has expired, and the delivery time starts only then.
11.4 Loss of the right of withdrawal. If you ask for an immediate start, your right of withdrawal ends when the service has been fully performed, i.e. when the report is delivered (section 10.3; §1837(a) CC). If you withdraw before delivery, section 11.2 applies.
11.5 No charge before work starts. I do not charge for identifying the parcel, and I ask for payment only after it (section 7.2). If you withdraw before you pay, you owe me nothing; if you withdraw after paying but before I start the report, I refund the full price without any deduction. Only work on the report after the confirmed order (section 2.4) counts under section 11.2 and §1834 CC. If you did not ask for an immediate start, I start the report only after the withdrawal period has expired.
12. Cancellation by the provider
12.1 The contract can be cancelled on my side only for the reasons stated in sections 5.2, 7.4, 7.5 (plot outside the Czech Republic), 9.3, 9.4 and 17. In all these cases I refund the full price paid without undue delay, no later than 14 days, by the same means of payment.
13. Rights for defective performance and complaints
13.1 The report is defective if it does not conform to the contract (§2615(1) CC), in particular if it:
- states the content of a cited source on the query date incorrectly or incompletely;
- lacks a section or check that should have been done under section 3.2, without stating in the report why it could not be done;
- concerns a parcel other than the confirmed one;
- is not in the language ordered.
13.2 Notify me of the defect (file a complaint) without undue delay after you discovered it or should have discovered it with proper care, no later than two years after delivery of the report (§2618 CC). Send the complaint to the contact e-mail address (published before orders open) or by post to Studentská 1024, 250 91 Zeleneč. State what you consider the defect to be and how you want it resolved.
13.3 I confirm receipt of the complaint in text form without undue delay, stating the date it was filed, its content, the remedy requested and your contact details (§19(2) CPA).
13.4 Remedy: you can ask for the defect to be removed by delivery of a corrected report, or for a reasonable price reduction; if the defect is a substantial breach of contract, you can also withdraw from the contract (§2106 and §2107 in conjunction with §2615(2) CC). I normally deliver the corrected report within 24 working hours (section 2.5). If the defect cannot be removed, or I do not remove it in time, you are entitled to a reasonable price reduction or may withdraw from the contract. If the correction changes the status of a finding (e.g. from “Fine” to “Open” or “Rules out building”), I refund the full price on request. Your statutory rights under §1914–1925, §2099–2112 (in conjunction with §2615(2)) and §2615–2618 CC are not limited by this.
13.5 I settle the complaint and inform you within 30 days of the day it was filed, unless we agree on a longer period (§19(3) CPA). If this period passes without result, you may withdraw from the contract or claim a reasonable price reduction (§19(4) CPA). I give you a confirmation of the date and manner of settlement, or the reasons for rejection (§19(5) CPA).
13.6 You are entitled to reimbursement of costs reasonably incurred in exercising your rights for defective performance (§1924 CC).
14. Liability
14.1 I am liable for damage under the Civil Code, in particular §2913 and §2950 CC. If the customer is a consumer, these terms do not exclude or limit my liability or the consumer's rights for defective performance in any way (§1812(2), §1814(1)(a) and §2898 CC).
14.2 The scope of the service and its result is defined in section 3. You make the decision to buy the plot and on further steps yourself. I recommend confirming the decisive facts with the documents named in the report (in particular the building office's preliminary information under §174 of Act No. 283/2021 Coll.) and consulting a lawyer (advokát) on legal questions. If damage arises or increases as a result of circumstances attributable to you (e.g. a wrongly entered parcel), the duty to compensate is reduced proportionately (§2918 CC).
14.3 Only for business customers who order within their business and are not the weaker party: total compensation for damage is limited to the price paid. The limit does not apply to damage caused intentionally or by gross negligence, or to harm to a person's natural rights (§2898 CC). Section 11 does not apply to business customers.
15. Use of the report
15.1 You may use the report to decide on buying the plot and preparing construction, including sharing it with people close to you, your lawyer, bank, mortgage adviser, designer or the building office. You may not publish or resell it without my consent.
15.2 I may use an anonymised sample of the report only with your separate express consent; this consent is not a condition of the order or of the launch price.
16. Personal data
16.1 The processing of personal data is governed by the Privacy Policy on my website. I never show birth numbers (rodné číslo) from land-register extracts in reports and I black them out in stored copies.
17. Sanctions
17.1 I do not provide services to persons on the sanctions lists of the European Union or the Czech Republic, to persons acting on their behalf, or to the Government of Russia or legal persons, entities and bodies established in Russia (Council Regulations (EU) No 269/2014 and No 833/2014, Act No. 1/2023 Coll.). If I find such a fact, I do not accept the order, or I cancel the contract and refund the full price unless sanctions law prevents it.
18. Complaints, out-of-court dispute resolution and supervision
18.1 I handle complaints at the contact e-mail address (published before orders open), normally within 5 working days.
18.2 Out-of-court resolution of consumer disputes. The competent body for out-of-court resolution of consumer disputes arising from the contract is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, website https://adr.coi.gov.cz (§14 and §20e(d) CPA). A petition can be filed no later than 1 year from the day you first raised the disputed claim with me (§20p CPA). The procedure is free of charge for consumers.
18.3 Compliance with consumer-protection duties is supervised by the Czech Trade Inspection Authority (www.coi.gov.cz), data protection by the Office for Personal Data Protection (www.uoou.gov.cz), and trade licensing by the competent trade licensing office. You can also complain to these authorities.
18.4 I do not follow any code of conduct.
19. Final provisions
19.1 The contract is governed by Czech law. If the customer is a consumer habitually resident in another country, the mandatory consumer-protection rules of that country are not affected. Jurisdiction of courts follows the law.
19.2 If a term of the contract can be interpreted in different ways, the interpretation most favourable to the consumer applies (§1812(1) CC). If the Czech version and a translation differ, the Czech version prevails; this does not affect the previous rule.
19.3 A change to these terms does not apply to contracts concluded before it takes effect.
19.4 If any provision is invalid or disregarded, the other provisions remain in force.
19.5 The contract does not oblige anyone to repeated performance; the obligation ends by performance. No minimum duration of the customer's obligations is set.
